1. General Information
1.1 The present General Terms and Conditions of Sale (hereinafter also referred to as the "Conditions") apply to the purchase of goods through the e-commerce website (hereinafter the "Website") by users residing in Switzerland, with a delivery address in Switzerland, who qualify as "Consumers" under the following article.
The Website is owned by Sonego Calzature, a company operated by Gilbox Sagl, with its registered office in Maroggia (Switzerland), via Baldassare Longhena 13, IDI: CHE-105.452.226 (hereinafter referred to as "Sonego Calzature," "Owner," or "Seller").
1.2 Purchases of Products made through the Website involve Sonego Calzature as the Seller and the individual making the purchase of one or more Products as the Buyer (hereinafter referred to as the "Consumer"). The Seller and Consumer will hereinafter be collectively referred to as the "Parties." Order fulfillment activities, including the delivery of Products, will be managed by the Seller.
1.3 The Owner holds the rights to the Website's domain name, logos, and trademarks associated with the Products presented on the Website, as well as the copyright over the Website's content.
1.4 Any communication from the Consumer related to and/or concerning the purchase of Products—including complaints, notifications, requests regarding the purchase and/or delivery of Products, the exercise of the right of withdrawal, etc.—must be sent to the Seller using the contact details and methods indicated on the Website and via email at info@sonegocalzature.ch.
1.5 Each purchase is governed by the General Terms and Conditions of Sale in the version published on the Website at the time the order is placed by the Consumer.
1.6 The Website is dedicated to retail sales and, as such, is intended for the exclusive use of Consumers. Individuals who do not qualify as Consumers are invited not to place purchase orders.
If one or more sales are made to a buyer who does not qualify as a Consumer, these Terms and Conditions shall apply, but, by way of derogation from their provisions:
a) the buyer will not be entitled to the right of withdrawal provided for in Article 10;
b) the buyer will not be able to benefit from the Product warranty set out in Article 8;
c) the buyer will not be granted any other protections provided herein in favor of the Consumer that reflect or comply with mandatory legal provisions;
d) the sales contract concluded between the Seller and the buyer will be governed by Swiss Law, excluding the rules of private international law. The exclusive legal jurisdiction is Lugano.
1.7 At the time of transmitting the purchase order, the Consumer agrees that the confirmation of the order details and the present Terms and Conditions will be sent to them via email at the address provided during registration on the Website or during the purchase process.
1.8 To make purchases through the Website, the Consumer must be of legal age (18 years old) and possess full legal capacity, which the Consumer expressly declares to have.
1.9 Any costs related to Internet access to the Website, including telephone charges, are the exclusive responsibility of the Consumer, according to the rates applied by the service provider selected by the Consumer.
2. Product Features and Their Availability in Different Geographic Areas
2.1 The Products are sold with the features described on the Website and in accordance with the Terms and Conditions published on the Website at the time the Consumer submits the order, with the exclusion of any other conditions or terms.
2.2 The Seller reserves the right to modify these Terms and Conditions at any time, at its sole discretion, without the need to provide prior notice to users of the Website. Any changes made will take effect from the date of publication on the Website and will apply only to sales concluded from that date onwards.
2.3 The prices, the Products available for sale on the Website, and/or their characteristics may be subject to change without prior notice. Such changes will only apply to orders that have not yet been confirmed at the time the modification is made. In any case, before submitting a purchase order under Section 3, the Consumer is encouraged to verify the final sale price.
2.4 The Website is accessible worldwide. However, the Products available on the Website can only be purchased by users residing in Switzerland and requesting delivery within Swiss territory.
3. Product Purchase Methods – Finalization of Each Individual Purchase Contract
3.1 The presentation of Products on the Website, which is not binding for the Seller, constitutes a mere invitation for the Consumer to submit a contractual purchase proposal and does not represent a public offer.
3.2 The Consumer's purchase order transmitted to the Seller via the Website constitutes a contractual proposal and is governed by these Terms and Conditions, which form an integral part of the order. By submitting the order to the Seller, the Consumer is required to accept these Terms and Conditions fully and without reservation. Before proceeding with the purchase of Products by submitting the purchase order, the Consumer will be asked to carefully read these Terms and Conditions and the right of withdrawal policy, as well as to print, save, or reproduce a copy for personal use. Additionally, the Consumer will be asked to verify and correct any errors in the input of their personal data.
3.3 The Consumer's purchase order is accepted by the Seller upon the Seller's transmission of an order confirmation email to the Consumer at the email address provided during registration on the Website or at the time of order submission if the Consumer is not registered. This confirmation email will include a link to the text of these Terms and Conditions, a summary of the order placed, a detailed breakdown of the price, shipping costs, and applicable taxes, as well as a description of the ordered Product. The Consumer's order, the Seller's order confirmation, and the applicable Terms and Conditions governing the relationship between the Parties will be electronically stored by the Seller in its information systems. The Consumer may request a copy by sending an email to the Seller at info@sonegocalzature.ch.
3.4 Each Product purchase contract is deemed concluded when the Consumer receives the Seller's order confirmation via email.
4. Procedure for Selecting and Purchasing Products
4.1 The Products displayed on the Website can be purchased by selecting the Consumer's chosen items and adding them to the designated virtual shopping cart. Once the selection of Products is complete, in order to proceed with the purchase of the items added to the cart, the Consumer will be invited to register on the Website by providing the required information, log in if already registered, or enter personal details to complete the order and finalize the contract. If the details provided in the order differ from those given during registration on the Website, the Consumer will be required to confirm their information (such as name, surname, etc.), as well as the delivery address for the selected Products, the billing address, and optionally, a phone number for any communications related to the purchase. The Consumer will see an order summary, which they can modify before proceeding. By clicking the purchase button, the Consumer confirms acceptance of these Terms and Conditions and submits the order, which will then be definitively sent to the Seller and will take effect as described in Section 3.2 of these Terms and Conditions. The Consumer will also be required to choose a shipping method and a payment method from the available options. If the Consumer opts for immediate payment (at the time of purchase) via credit card, PayPal, or other payment methods available on the checkout page, they must provide the relevant payment details through a secure connection. For accounting and administrative purposes, the Seller reserves the right to verify the Consumer's personal details.
4.2 If, during the product selection process on the Website, as described in Section 4.1, the Consumer notices that the price of one or more Products selected for purchase is significantly lower than the usual price, excluding applicable discounts and promotions at the time, due to an obvious technical issue on the Website, they are asked not to complete the purchase order and to report the technical error to the Seller's Customer Service by sending an email to info@sonegocalzature.ch.
5. Delivery of Goods and Acceptance
5.1 The Website indicates the availability of Products and their estimated delivery times; however, this information is purely indicative and not binding for the Seller.
5.2 The Seller commits to making reasonable efforts to meet the delivery times indicated on the Website and, in any case, to complete the delivery within a maximum of 30 (thirty) days from the day following the Consumer's order submission. In the event that the Seller is unable to fulfill the order due to the Product being unavailable, even temporarily, the Seller will notify the Consumer in writing and proceed with the refund of any payments already made by the Consumer for the Product, in accordance with Section 5.3 below.
5.3 The shipment of Products ordered by the Consumer will take place according to the shipping method selected by the Consumer from the available options indicated on the Website at the time of order submission. The Consumer agrees to promptly check, within the shortest possible time, that the delivery includes only and all of the purchased Products, and to immediately notify the Seller of any defects in the Products received or discrepancies from the order placed, following the procedure outlined in Article 8 of these Terms and Conditions. Failing this, the Products will be deemed accepted. If the packaging or wrapping of the Products ordered by the Consumer arrives visibly damaged, the Consumer is advised to refuse the delivery from the carrier/shipper or to accept it "with reservation".
6. Prices, Shipping Costs (if applicable), Taxes, and Fees
6.1 The price of the Products is the one indicated on the Website at the time the Consumer submits the order. Prices include standard packaging costs, VAT at 8.1% (if applicable), and any indirect taxes (if applicable), while shipping costs are covered by the Seller.
6.2 The Consumer is required to pay the Seller the total price as stated in the order and in the order confirmation email sent by the Seller to the Consumer.
6.3 Shipping is free with no minimum order amount required.
7. Payments
7.1 The payment for Products purchased through the Website must be made within a strict deadline of 6 (six) days from the date the Seller sends the order confirmation to the Consumer. The Consumer expressly agrees that the Seller will begin contract execution only after the payment for the purchased Product(s) has been credited to the Seller's account.
7.2 Payment can be made via credit card, PayPal, or other payment methods available on the checkout page, under the conditions described below. The Seller may allow additional payment methods, which will be listed in the payments section of the Website.
7.3 Where required by applicable law, the Seller will promptly send the Consumer the tax receipt for the purchase via email to the address provided by the Consumer. If the purchased Products are to be delivered within Italy, the receipt will be sent electronically. For all other cases, the receipt will be provided in paper format, included with the shipped Products.
8. Legal Warranty of Conformity, Reporting Non-Conformities, and Warranty Interventions
8.1 The Seller guarantees that the Products will be free from design and material defects and will conform to the descriptions published on the Website for a period of 2 (two) years from the date of delivery to the Consumer. The application of any warranty is excluded in cases of improper use or washing of the Product that does not comply with its intended purpose and the instructions/warnings provided by the Seller and/or the Owner, as indicated in the relevant documentation, labels, or tags. Furthermore, the Seller guarantees that the Product meets the standard requirements in terms of quantity, quality, durability, functionality, compatibility, and safety typically expected of goods of the same type.
8.2 The Consumer may report any defects or non-conformities by sending a correctly completed return form to Customer Service at info@sonegocalzature.ch, including a description of the defect and/or non-conformity found, along with the necessary supporting documentation specified in the return form (at least one (1) photograph of the Product, the order confirmation issued by the Seller, and/or the invoice or receipt). Any legal action regarding defects that were not intentionally concealed by the Seller must, in any case, be brought within twenty-six (26) months from the date of delivery of the Products to the Consumer.
8.3 Upon receipt of the return form and related documentation, the Seller will assess the defects and non-conformities reported by the Consumer through its customer service. After performing the necessary quality checks to verify the actual non-conformity of the Product, the Seller will decide whether to authorize the return and will notify the Consumer via email. Authorization to return the Products does not in any way constitute recognition of a defect or non-conformity, as its existence must be confirmed upon receipt of the returned Product. Products for which the Seller has authorized the return must be sent back by the Consumer, along with a copy of the return authorization communication containing the "Return Code", within 30 (thirty) days from the date of reporting the defect or non-conformity, to the following address:

8.4 In the event of defects or non-conformity, the Consumer has the right to have the Seller restore the conformity of the Product through repair or replacement, or to seek alternative remedies in cases expressly provided for under Article 130 of Legislative Decree No. 206/2005.
If the Seller has committed to reimbursing the Consumer for the amount paid, the refund will be processed, whenever possible, using the same payment method used by the Consumer at the time of purchase or via bank transfer. The Consumer is responsible for providing the Seller with the necessary bank details for the transfer by sending an email to info@sonegocalzature.ch, ensuring that the Seller has all the required information to process the refund.
9. Liability for Damage Caused by Defective Products
9.1 With regard to any damages caused by defects in the Products, the provisions of the Consumer Code shall apply.
9.2 The images and colors of the Products published on the Website may differ from the actual ones due to local system settings and/or the devices used for display. In the event of a lack of conformity between the purchased Products and their description on the Website, or in the case of a defective Product, the Customer is entitled to a refund for the non-conforming item, upon submission of photographic evidence highlighting the damage or non-conformity via email to info@sonegocalzature.
9.3 The Seller will then inform the Customer of the applicable refund process, which, at the Customer’s discretion, may also be carried out in the form of discount vouchers to be used for a future purchase, with no further liability of the Seller under any circumstances.
10. Right of Withdrawal
10.1 Subject to the exceptions listed in Section 9, the Consumer has the right to withdraw from any contract concluded under these Terms and Conditions without providing any justification and without incurring any penalties, within 15 (fifteen) days from the date the Product was delivered, or, in the case of multiple Products purchased in a single order but delivered separately, from the date the last Product was delivered.
10.2 Subject to the exceptions listed in Section 9, the Consumer has the right to withdraw from any contract concluded under these Terms and Conditions without providing any justification and without incurring any penalties, within 15 (fifteen) days from the date the Product was delivered, or, in the case of multiple Products purchased in a single order but delivered separately, from the date the last Product was delivered.
